Judge Discharges Defendants in Long-Running Abokobi Land Sale Dispute

The Circuit Court in Accra has cleared two defendants, Alberta Abi Amartey and Emmanuel Anang Yemoh, of charges related to a disputed GH¢190,000 land transaction, after the case was struck out for lack of prosecution.

Presiding Judge Kwabena Kodua Obiri-Yeboah made the ruling on April 21 last year, noting that despite repeated warnings, state prosecutors had failed to submit the required legal processes to move the case forward.

A third accused, Philip Addogah, was not present in court when the decision was handed down.

The case dates back to October 2023, when Amartey and Yemoh were granted GH¢150,000 bail each on allegations that they had conspired with Addogah to sell six supposed litigation-free plots of land at Abokobi to lawyer Solomon Aubin. The land was intended for a church construction project.

However, shortly after the purchase, ownership disputes arose when the Brekusu and Akrodey families claimed rights to the property. The disagreement escalated, leading to the partial demolition of a fence wall that Mr Aubin had begun to build on the site.

Prosecutors had argued that the accused persons knew the land was already the subject of a legal dispute before the sale but proceeded with the transaction regardless. With the case now dismissed, the defendants walk free, though the underlying land conflict remains unresolved.
