Why Mahama’s Choice of Baffoe-Bonnie as Chief Justice Has Excited Martin Kpebu

Prominent private legal practitioner Martin Kpebu has backed President John Dramani Mahama’s decision to nominate Justice Paul Baffoe-Bonnie as Ghana’s next Chief Justice, describing him as the right man for the role at this critical moment.

Speaking on TV3’s Ghana Tonight on Friday, September 26, Kpebu highlighted three main reasons for his support: seniority on the bench, a career marked by cross-party appointments, and proven independence during the 2012 election petition.

Seniority and Stability

Kpebu stressed that elevating the most senior justice brings harmony to the judiciary, pointing to past tensions when younger judges were chosen over their seniors. He argued that Justice Baffoe-Bonnie’s long service at the Supreme Court makes him well-placed to manage relationships within the bench smoothly.

Cross-Party Appointments

Tracing his judicial career, Kpebu recalled that Baffoe-Bonnie was first appointed to the High Court in 2000 by former President Jerry John Rawlings, promoted to the Court of Appeal by John Agyekum Kufuor in 2006, and elevated to the Supreme Court in 2008. For Kpebu, his nomination by President Mahama underscores the value of merit over partisanship in key public appointments.

Independence During Election Petition

Kpebu also praised Justice Baffoe-Bonnie for the independence he displayed in the 2012 election petition. Despite being a Kufuor appointee, he cast a decisive vote on unsigned pink sheets that ultimately favoured then-President Mahama. According to Kpebu, that ruling proved his capacity to rise above political influence.

Though that decision reportedly drew backlash under the Akufo-Addo administration, Kpebu noted that Justice Baffoe-Bonnie stood firm, even when calls for his resignation surfaced.

A Step Toward Judicial Independence

Kpebu concluded that Mahama’s nomination sends a powerful message: judicial appointments should not be determined by party loyalty. In his view, Baffoe-Bonnie embodies the maturity, experience, and impartiality needed to strengthen the judiciary’s independence.

President Mahama announced the nomination on September 23, 2025, under Article 144(1) of the 1992 Constitution, following the removal of Justice Gertrude Torkornoo earlier this month. Parliament is expected to vet and confirm the appointment in the coming weeks.
