Supreme Court Quashes Tamale High Court Ruling that Nullified Kpandai Parliamentary Election

The Supreme Court has quashed a nullification ruling on the Kpandai Parliamentary election which rendered the seat vacant.

In a 4-1 majority decision delivered on January 28, 2026, the apex court set aside the November 24, 2025, judgment of the Tamale High Court alongside all consequential actions and orders that arose from the decision.

This means that Matthew Nyindam will reassume the Kpandai seat and act in the office accordingly.

Background
The National Democratic Congress (NDC) candidate in the 2024 election, Daniel Nsala Wakpal, filed a petition at the High Court claiming the December 7 election was marred by serious irregularities.

He pointed out inconsistencies in Form 8A (the “pink sheet”) from 41 out of 152 polling stations, citing breaches of Regulations 39 and 43 of the Public Elections Regulations (CI 127).

The court ruled that these irregularities compromised the election’s integrity and ordered the Electoral Commission (EC) to conduct a rerun of the parliamentary election in the entire constituency within 30 days.

Meanwhile, the New Patriotic Party candidate (NPP), Matthew Nyindam, who until the ruling occupied the seat, filed an appeal against the Court ruling.
