John Darko, legal counsel for Matthew Nyindam, has urged the National Democratic Congress (NDC) to accept the Supreme Court’s verdict on the Kpandai parliamentary election instead of pursuing a review, saying the party is unlikely to succeed.
Speaking in an interview on JoyNews’ The Pulse on Wednesday, Mr Darko expressed surprise at comments by NDC Majority Chief Whip Rockson-Nelson Deafeamekpor indicating the party may seek a review of the apex court ruling.
He added that the threshold to have a Supreme Court review admitted is very high and, in his view, the NDC would not meet it.
“They should just admit that they lost this one, and let’s all work together to build our country,” he said.
His comments come after the NDC insisted that the Supreme Court’s decision to reinstate Matthew Nyindam as Member of Parliament for Kpandai does not close the legal chapter on the constituency’s 2024 parliamentary election and suggested that constitutional and legal avenues remain open.
Asked whether the potential review posed any threat to Mr Nyindam’s victory, Mr Darko said: “Absolutely not at all, we are not threatened. In fact, I know that they won’t file it… They know that it is just going against time.”
He explained that a review is not automatic and must demonstrate a significant error in the Supreme Court’s judgment:
“In fact, a review is to tell the court that some miscarriage will happen if the judgment is allowed to stand. A review is to say that the judges should have taken into consideration some important statutory provisions and they did not. You are telling the court that if they don’t review the decision, some major problem will happen in terms of legal precedent or jurisdictional error. Unless you can prove any of these, there’s no way the court will even give you the opportunity.”
