Private legal practitioner, Justice Abdulai, has outlined the procedure Member of Parliament for Kpandai, Matthew Nyindam, must follow before formally resuming his seat in Parliament after the Supreme Court restored his mandate.
Speaking on Joy FM’s Top Story on Wednesday, Mr Abdulai said that although the apex court has reinstated Mr Nyindam, he cannot automatically walk into Parliament when the House reconvenes, particularly because the seat had earlier been declared vacant.
According to him, the first step is for Mr Nyindam to formally notify the Clerk of Parliament of the Supreme Court’s decision.
“Indeed, my honourable friend Matthew Nyindam would have to employ the tools available by informing the Clerk of Parliament. The notification must be supported with the relevant court documents, including the orders or judgment delivered by the Supreme Court,” he explained.
He added that it would be prudent for Mr Nyindam to obtain certified true copies of the Supreme Court ruling to serve as official proof of his reinstatement, pending formal recognition by Parliament.
While the court’s decision restores Mr Nyindam’s mandate, Mr Abdulai stressed that Parliament must be duly informed before he can officially take his place on the floor of the House.
The explanation follows the Supreme Court’s 4–1 majority decision to quash a Tamale High Court judgment that had annulled Mr Nyindam’s election as Member of Parliament for Kpandai, citing jurisdictional error.
The apex court upheld an application filed by Mr Nyindam invoking its supervisory jurisdiction, thereby restoring his parliamentary mandate.
With Parliament expected to reconvene shortly, the clarification addresses growing public interest over the legal and procedural steps required for Mr Nyindam’s return to legislative duties.
