A High Court in Accra has ordered the Economic and Organised Crime Office (EOCO) to stop investigations and other activities against Sesi-Edem Company Limited and its directors, including Dr Gabriel Tanko Kwamigah-Atokple, a member of the Council of State.
According to a press statement issued by Sesi-Edem Company’s solicitors, Knightscild Chambers, the Court, in the exercise of its supervisory jurisdiction, restrained EOCO from continuing any purported investigation into the company and its directors in relation to a gold sale transaction with JG Resources Ltd, and from taking any steps that would interfere with the company’s operations.
The court further restrained EOCO from maintaining a “wanted” declaration against the directors of Sesi-Edem Company Limited in connection with the dispute involving JG Resources Ltd.
In November 2025, JG Resources Ltd petitioned EOCO, alleging that only 29 kilograms of gold had been delivered under a 50-kilogram supply agreement. EOCO proceeded to characterise the matter as one of defrauding by false pretences and money laundering, and imposed administrative freezing orders on Sesi-Edem Company’s bank accounts.
Sesi-Edem Company Limited successfully challenged those actions by EOCO before the High Court. In a ruling delivered on 19 March 2026, the Court held that EOCO had acted outside its statutory mandate and in breach of the company’s constitutional right to administrative justice. The Court further found that the facts disclosed no basis for allegations of fraud or money laundering and ordered the defreezing of the company’s accounts.
EOCO, on March 30, 2026, declared the company’s directors “wanted,” indicating that investigations would continue. This prompted fresh legal action by the company to restrain EOCO’s actions.
The ruling, delivered as part of the court’s supervisory jurisdiction over EOCO, also bars EOCO, its officers, and any persons acting on behalf of EOCO from inviting, detaining, arresting, charging, or taking any action that interferes with the liberty of the company or its directors regarding the matter.
