Alhaji Siba Yahaya, a businessman previously accused of defrauding foreign investors in a gold scam valued at over $1 million, has been discharged after the Accra Circuit Court struck out the case against him.
According to earlier reports, Yahaya had earlier failed to meet a GH¢6.340 million bail condition imposed by the court, which required him to provide three sureties, two of whom were to be public servants with landed property, half of which must be worth GH¢3 million.
The case, originally presided over by Emmanuel Essandoh, had also seen a bench warrant issued on September 13, 2021, after Yahaya failed to appear, though it was later rescinded when he presented himself to court.

At that time, Yahaya pleaded not guilty to charges of selling and buying minerals without a licence, conspiracy to defraud by false pretences, and defrauding by false pretences.
However, on Friday, April 30, 2025, the Accra Circuit Court, presided over by Her Honour Lawrencia Darkowaa Gyamfi, struck out the case.
The court noted that on three separate occasions, no attorney from the Office of the Attorney General appeared to prosecute the matter, indicating that the AG’s office was not prepared to pursue the case.
Her Honour ruled that the case was therefore struck out for want of prosecution, and as a result, Alhaji Siba Yahaya and the other two accused persons were discharged.
