MCE, assemblyman dragged to presidency over alleged seizure of public toilet

The Ayawaso Central Municipal Chief Executive (MCE), Rudolf Collingwood-Williams and Assemblyman for Kotobabi Electoral Area, Tommy Thompson, have been petitioned to the office of the President of Ghana over an alleged illegal takeover of a public toilet facility in Kotobabi.

In a formal petition dated January 23, 2026, A private construction and sanitation management company Prince Setraco Ghana Limited, accused the MCE and Assemblyman Thompson of interfering with the company’s operations at a 20-seater modern toilet facility leased to them by the Ayawaso Central Municipal Assembly.

The company explained that it signed a 15-year lease agreement with the Assembly on May 1, 2023, granting it the right to renovate, operate and collect revenue from the facility while paying an agreed share to the Assembly. According to the petition, Prince Setraco Ghana Limited had been operating the facility for two years without issue.

However, on September 13, 2025, the company claims that Assemblyman Thompson, along with local youths and personnel linked to the Osu Castle National Security, forcibly took control of the facility and began collecting all revenue. When the matter was reported to the MCE, he allegedly failed to intervene, prompting the company to involve the Nima Police Station.

“The kotobabi toilet facilities was listed for Price Straco Ghana Limited to renovate, operate and also pay revenue to the assembly. the facilities were listed to us for fifteen (15) years which we have been running for the past two (2) years now.

“On the 13th of September,2025, Tommy Thompson invaded the toilet with some central Ayawaso boys and some of the boys work as national securities at the osu castle.

“They have been collecting the revenue made for the assembly and be sharing it among the national security’s boys at the Osu castle. We informed the MCE about this development, but he refused to take action.

“On the 16th of September, 2025, we reported the issue to the Nima Police Station. the divisional commander of the Nima Police Station directed inspector John Atitso to Investigate the matter, through the investigation, the boy at the toilet was arrested and he gave a statement that Tommy Thompson gave him Authorization to be receiving money from the toilet facility and he continued that all the revenues received for the two days were given to Tommy Thompson,” part of the petition to the presidency said.

Investigations by the police reportedly confirmed that Thompson authorized the collection of revenues from the facility. The company claims that despite repeated attempts to resolve the issue, the MCE failed to take action, forcing Prince Setraco Ghana Limited to take legal action.

The company stated in its petition to President John Dramani Mahama that the unpaid revenue to the Assembly over six months amounts to GHC 10,080, while the company’s outstanding bank loan totals GHC 180,000. They urged the President to investigate and help resolve the matter.

Separately, the company has filed a lawsuit at the District Magistrate Court in Accra, seeking:

A declaration confirming its 15-year leasehold interest over the facility.

Daily compensation of GH¢ 2,000 for lost revenue since September 19, 2025.

An injunction preventing Assemblyman Thompson and his agents from further interference.

It be recalled that , the company filed a lawsuit against Tommy Thomson, for allegedly using force to seize control of a 20-seater public toilet facility in Kotobabi.

The case, filed at the District Magistrate Court in Accra, accuses the Assemblyman of unlawfully taking over the operations of a modern water closet facility that the company claims to have constructed and operated under a valid 15-year lease agreement with the Ayawaso Central Municipal Assembly.

According to court documents, the plaintiff, Prince Setraco Ghana Ltd, is seeking multiple reliefs, including a declaration of ownership over the leasehold, a daily compensation of GH₵2,000 for lost revenue and an injunction restraining the defendant and his agents from further interference.

In its statement of claim, the company explained that it entered into a formal agreement with the Ayawaso Central Municipal Assembly on May 1, 2023, which granted it a 15-year leasehold interest in the site of a dilapidated KVIP toilet facility at Kotobabi.
