The governing National Democratic Congress (NDC) has maintained its call for the removal of the Electoral Commission’s leadership, despite the Chief Justice’s dismissal of petitions seeking their ouster.
The party’s Legal Director, Edudzi Tamakloe, speaking on Joy FM’s Super Morning Show on Thursday, February 19, says the decision will not alter the NDC’s position that the current EC Chair and her deputies should step aside.
“I want to make the point that the NDC still believes that the current composition of the Electoral Commission and how they have conducted their work over the past five years leaves much to be desired,” he said.
Chief Justice Paul Baffoe-Bonnie, in dismissing the petitions seeking the removal of EC heads and the Special Prosecutor, acknowledged that the concerns raised were serious but ruled that they did not meet the prima facie threshold required under Article 146 to trigger a removal process.
The ruling has generated mixed reactions across the political landscape.
However, Mr Tamakloe insisted the party remains resolute.
He added that while the Chief Justice appeared to recognise the administrative and constitutional weight of the issues raised, the dismissal suggests that the proper avenue may lie elsewhere.
“From what I am reading, it does appear that the Chief Justice has taken the position that the matters raise very serious administrative and constitutional issues, and so possibly the fault is not Article 146 alone. Those matters can be litigated in a different place other than the Supreme Court,” he noted.
