The National Labour Commission (NLC) has flagged the industrial action declaration by the Civil and Local Government Staff Association, Ghana (CLOGSAG) as ultra vires.
According to the Commission, the group failed to comply with legal provisions before declaring the said strike set to take effect on March 9, 2026.
“The National Labour Commission, in pursuance of its powers under Section 139 of the Labour Act, 2003 (Act 651) directs CLOGSAG to rescind the decision as it contravenes Sections 159 and 160 of Act 651, which enjoins a party who intends to take a strike action to notify the other party and the Commission by serving seven days’ notice; and to resort to strike only upon expiration of the seven days’ notice where there is no intervention under Section 161 of Act 651,” the statement said.
“CLOGSAG failed and/or refused to comply with these provisions of the Law as stated above; consequently, the declaration of strike by CLOGSAG constitutes an illegality under the Labour Act, 2003 (Act 651),” the NLC stated.
It further directed representatives of CLOGSAG and the employer to appear before it on Wednesday.
“The disputing parties are hereby summoned to appear before the Commission on Wednesday, 11th March 2026, at 2 pm. The Commission remains committed to ensuring a peaceful and harmonious relations environment within the context of the Law,” the statement added.
Strike
On Thursday, CLOGSAG issued a statement directing its members to stay at home from March 9.
This stemmed from the government’s failure to implement its approved conditions of service dating back to 2019, according to the CLOGSAG Executive Secretary, Isaac Bampoe Addo.
At an earlier presser on February 19, the Association expressed frustration over the delay in executing the agreed terms, despite what it said were extensive negotiations and official approval three years ago.
He stated that two separate Memoranda of Understanding (MOUs) regarding salary structures, allowances, and other benefits from the negotiations have yet to be implemented.
The Association felt “taken for granted” and thereby deems the strike action as the appropriate means to seek a remedy.
