Why State Is Losing Money in Nolle Prosequi Decision

Why the Kaneshie Court Couldn’t Grant Bail to This Man Accused in a Riot Killing

Solomon Owusu has publicly expressed his frustration over the Attorney General’s recent decision to drop charges in a high-profile case involving stolen state funds, raising serious questions about the terms and reasoning behind the move.

In a passionate interview, Owusu criticized the Attorney General’s decision to file a nolle prosequi—a legal term that essentially means discontinuing prosecution—without being legally compelled to provide an explanation, only to then issue one that opens the door to further scrutiny.

He argued that if the Attorney General voluntarily offers reasons for such a decision, then the public has every right to examine and challenge those justifications. Specifically, Owusu questioned the vague reference to a “60 percent recovery” in the official statement. He demanded clarity: what exactly does that 60 percent amount to in cedis?

What seemed to trouble him most was the acknowledgment in the Attorney General’s statement that wrongdoing had indeed occurred, yet the state was still settling for a partial recovery rather than pursuing full restitution with interest. Owusu questioned why the burden of loss should fall on the state rather than being fully recouped from the perpetrators.

Citing the infamous National Service fraud case—which involved GH₵548 million—he pointed out that, based on this new precedent, it would be unacceptable for the state to settle for just 60% of that amount. He condemned the logic behind such compromises, insisting that all stolen funds must be retrieved in full.

Visibly outraged, Owusu declared that “every penny” siphoned from public coffers should be recovered, rejecting any move that suggests otherwise as a disservice to the country.

The video of his interview, posted by TV3 Ghana on Instagram on Wednesday, July 23, 2025, has since sparked widespread public reaction, with many echoing his concerns about accountability and justice.
