Unlawful and Unfair! Fired Public Workers Take Legal Action Against Government

A group of 40 former public sector employees, hired in 2024, have taken legal action against the government, challenging their dismissals, which they claim were unlawful.

The affected individuals were reportedly removed from their positions following a directive issued by President Mahama’s Chief of Staff, Julius Debrah, on February 10, 2025.

The directive instructed public sector agencies to terminate employees who were recruited under the previous NPP administration after December 7, 2024—the day of the presidential and parliamentary elections.

The directive justified the terminations by citing good governance principles, asserting that post-election appointments were inconsistent with established practices.

However, the dismissed workers argue that their recruitment followed due process, including aptitude tests and formal interviews, with some even receiving their appointments before the stated cut-off date.

Represented by Dame and Partners, a law firm associated with former Attorney General Godfred Yeboah Dame, the plaintiffs have filed their lawsuit against the Attorney General, along with six government institutions: the Ghana Revenue Authority, National Lottery Authority, Driver and Vehicle Licensing Authority, Ghana Ports and Harbours Authority, Ghana Shippers Council, and the National Health Insurance Authority.

They are seeking several legal remedies, including a declaration that the dismissals were unconstitutional, an order to reinstate them, and damages for the inconvenience and hardship caused.

The lawsuit also demands that public sector agencies refrain from terminating employees outside the conditions set by Article 191 of the Constitution.

Leading public criticism of the dismissals, Tafo MP Ekow Vincent Assafuah argues that the case represents a broader issue affecting thousands of unlawfully terminated workers.
