Chief Justice Gertrude Torkornoo has filed a new affidavit at Ghana’s Supreme Court, intensifying her legal battle against the special committee investigating her. This supplementary affidavit, submitted on Monday, May 26, 2025, contains serious allegations accusing the committee of unfair treatment and violating her constitutional rights.
The Chief Justice claims the committee’s conduct has been degrading and inhumane, arguing that her dignity has been compromised in violation of Ghana’s Constitution.
A major point of contention is the venue of the hearings. Unlike previous similar cases held at the Judicial Service’s Court Complex, the committee has chosen to conduct the sessions within the high-security confines of Osu Castle. Justice Torkornoo describes this as an unusual decision designed to increase pressure on her.
She further complains that the committee has not provided her with legal grounds or clear criteria for forming a prima facie case, hindering her ability to prepare an effective defense. Additionally, she alleges that hearing dates were set without notifying her legal team, resulting in a session being scheduled when her lawyer was unavailable.
Another concern raised is the committee’s allowance for petitioners to present evidence through witnesses rather than appearing in person, a practice she strongly opposes.
Justice Torkornoo also reveals that she has endured significant mental stress, citing restrictions placed on her such as denial of access to her mobile phones, invasive body searches, and prohibition of her husband and children from attending the hearings. In contrast, petitioners and their lawyers reportedly enjoyed more lenient treatment, including being allowed to keep their phones.
She views these actions, coupled with the choice of Osu Castle as the venue, as deliberate tactics aimed at applying psychological pressure against her during the investigation.
