Dr. Kojo Pumpuni Asante, the Director of Programmes and Policy Engagement at the Centre for Democratic Development (CDD-Ghana), has raised concerns regarding the involvement of the Supreme Court in political cases. He believes that the continuous adjudication of political matters by the apex court could undermine the principle of checks and balances.
In an interview monitored by News & Vibes, Dr. Pumpuni Asante suggested that political disputes should be resolved through other institutions rather than bringing them before the Supreme Court.
He emphasized the need to avoid situations where every disagreement between politicians ends up in court, as this could politicize the judiciary and raise questions about its independence.
Dr. Pumpuni Asante highlighted the importance of the Supreme Court finding legal grounds to decline sitting on certain cases. He stressed that encouraging politicians to bring every dispute to the court could overwhelm the judiciary and compromise its role as a check on other branches of government.
Furthermore, he pointed out that many African countries experience post-election disputes, leading to a continuous influx of political cases in their courts. Dr. Pumpuni Asante emphasized the need for legal mechanisms to manage and limit such disputes to prevent them from overshadowing other judicial responsibilities.
